Arbitration & Mediation Process
01
Initial Inquiry & Conflict Review
The process begins with an initial inquiry so that availability and potential conflicts can be considered. Initial information should be limited to what is reasonably necessary to identify the parties and representatives, understand the general type of matter and consider potential availability.
02
Appointment & Terms
If appropriate, the arbitrator or mediator may be appointed in accordance with the parties' agreement, applicable legislation and any governing procedural rules. The general terms of the engagement, including fees and cancellation provisions, are confirmed.
03
The parties and their representatives prepare for the process, which may include exchanging key information and submissions. Proceedings are then conducted in accordance with the applicable procedural framework, which may involve written and oral components.
